The Democratic Party has reacted days after the publication of facts by Boldnews.al regarding Artur Methani’s illegal candidacy for the post of High Justice Inspector.
The PD has requested the Justice Appointments Commission to disqualify Artur Methani from the post.
DECLARATION OF THE DEMOCRATIC PARTY, SECRETARY OF LEGAL AFFAIRS
With this statement, the Democratic Party publicizes the next scandal initiated by Prime Minister Rama, who does not stop at seizing every independent institution of justice.
The most recent case is that of the Council of Justice Appointments (KED), which at the meeting for the selection of candidates for the post of High Inspector of Justice decided to qualify as the main candidate that of Artur Metani despite not meeting the constitutional legal criteria for this important position.
This decision of the ECHR is in contradiction with the Constitution and the law “On the organs of governance of the justice system”. The Constitution of the Republic of Albania, in Article 147 / d, point 3, provides that “… The candidate for High Inspector of Justice must not hold political office in public administration, or leadership positions in political parties for the last 10 years prior to candidacy. “.
In addition, the Law on Governing Bodies of the Justice System, in Article 199 / point 1 / dh, stipulates:

- dh) Has not held political office in public administration or leadership positions in political parties for the last 10 years prior to candidacy;
Artur Metani is in a state of constitutional and legal detention. He has held the position of Legal Adviser to the President of the Republic from May 2002 to July 2012.
According to Law no. 84/2016 “On the Provisional Reassessment of Judges and Prosecutors” (Vetering Law), Article 3, paragraph 17, the position of Advisor to the President is considered a “political function” in public administration. For the simplest we are quoting the law 🙁 article 3 item 17)
– “Expression has not exercised political functions in public administration” means that it has not been a Member of Parliament, Prime Minister, Deputy Prime Minister, Minister, Deputy Minister or Clerk of the Cabinet of the President of the Republic, the President of the Assembly, the Prime Minister, the Deputy Prime Minister, or the Minister who performs the duties of cabinet director, advisor, assistant, spokesman or personal secretary of the cabinet head. ”
So, based on this definition, Artur Metani turns out to have been a “political functionary” for the last 10 years as part of the President’s Cabinet.
To summarize:
Voting law considers the President’s adviser a political function.
The constitution and the law on the judiciary prohibit anyone from running for political office for the past 10 years.
Under these circumstances, the qualification of Artur Methani by the KED as one of the leading candidates for the post of High Justice Inspector is in violation of the Constitution and the law in question.
But the KED, as we already know, is run by Edi Rama’s loyal Dvorani – Arta Marku. They are ready to do anything to fulfill the orders of their Prime Minister, whose mission is to capture every cell of the new judiciary.
Methani currently holds the position of State Advocate, appointed here directly by Prime Minister Rama. He is also the brother of PM and former Socialist Minister Eglantina Gjermeni. Well in these countries Edi Rama does not assign without giving strong evidence of loyalty.
Same as MP Felaj’s husband who was appointed a prosecutor by the KLP without a master’s degree and without a vet. The same situation is happening for the appointment of Artur Methani as Senior Justice Inspector by the KED.
The qualification of Artur Methani’s candidacy for ILD is unconstitutional and illegal, so we ask the KED to reconsider its decision and disqualify the candidacy in question. Otherwise no one believes in the independence of the new justice organs from the Prime Minister, who is turning them into his private organs.
