The Vetting Commission does not stop producing negative news. Another commissioner of the structure that will carry out the control of judges and prosecutors is in violation of the law.
VojoMalo is the leader of the company “Vojo& Partner” registered at the National Registration Center as a “natural person” since 1996. In June 2017, he is elected by the Parliament to the post of Deputy Commissioner of the Vetting Commission. The Law on “Transitional Reassessment” treats the commissioners with substitute commissioners in the same manner as in the treatment of salaries and bonuses, as well as in the detention of these officials based on the law on conflict of interest.
Albanian legislation has provided for commissioners to work full time. In this way, the law prohibits this official level from working elsewhere full time. Moreover, the law “On the prevention of conflicts of interest ….”, Provides that senior and middle level officials can not work in free professions, including a “lawyer” physical person.
This is foreseen by the law and it is clear that the commissioner (substitute) VojoMaloo is in the open conflict of interest situation with his private activity as a lawyer. “Boldnews.al” has reviewed the public information of the company “Malo& partners”, where it turns out that VojoMalo continues to be the head of the law office. He holds the position of “Managing Partner”, the most important man in this company. Also, on the site of the National Registration Center, the commissioner (substitute) VojoMalo turns out to be a “physical-lawyer” with active status, with NIPT 31516069 R.
In addition to the violation of the law on the prevention of conflicts of interest, Commissioner VojoMalo is in violation of the law on which he has been elected in the public-Vetting post. This law provides that the status of Commissioners of the Vetting Commission is the same as that of judges and prosecutors. The latter, by the way, are not allowed to practice the lawyer.
So, equally for Commissioners, they should not practice the profession of lawyer as long as they are appointed to the most important institution that aims to purge the justice system from corruption and inability.
It is clear that the acceleration of the parliamentary majority for the selection of Vetting’s commissioners has brought as a product the appointment of commissioners who are themselves in violation of the law, affecting the reduction of trust on this very important institution.
So far, two other Commissioners have proved to be an active part of the policy, despite the fact that this was one of the preconditions for appointing them on duty.
Another commissioner, as previously reported, “Boldnews.al” has been in flagrant conflicting interests with one of the subjects he has been in control. In fact, what is being ascertained so far is that the Vetting Commission, but not any other higher institutions, have given no formal or formal response to the violations of the law by at least 3 commissioners so far
