While the Independent Qualification Commission (KPK) confirmed him in office, passing the vetting, the Public Commissioner appealed against this decision to the Shkodra Court of Appeal Judge Astrit Kalaja.
“The KP, within the legal deadline, appealed to the Special Appeals Panel before the Constitutional Court against Decision no. 224, dated 20.12.2019, of the Independent Qualification Commission, on the subject of reassessment, mr. Astrit Kalaja, judge at the Court of Appeal of Shkodra. The Public Commissioner considers that, given the state of the facts and evidences administered by the Independent Qualification Commission, the decision is in its entirety vulnerable and, consequently, the subject of reassessment does not reach a reliable level for confirmation in office ”, is said in the complaint.
The Public Commissioner requests that the causes of this complaint to be considered by the Special Appeals Panel and, at the conclusion of the consideration of the case in public hearing, to decide to amend Decision no. 224, dated 20.12.2019, of the Independent Qualification Commission, and the dismissal of the reassessment subject, Mr. Astrit Kalaja.
“Pursuant to Article 16, paragraph 1, of the Rules of Procedure of the Institution of Public Commissioners, the complaint was published on the official website of this institution. The Institution of Public Commissioners is set up and operates pursuant to Article 179 / b and the Annex to the Constitution of the Republic of Albania and Law no. 84/2016, “On the Provisional Reassessment of Judges and Prosecutors in the Republic of Albania”. Public Commissioners represent the public interest during the transitional reassessment process of judges and prosecutors in the Republic of Albania ”, the report concludes.
