The Independent Qualification Commission (KPC) found some problems in the property criterion for the Tirana court chairman, Enkeledi Hajro. For several years, the judge did not cover its incomes, while there were some suspicions of transactions for the purchase of an apartment worth 82 thousand euros and two vehicles.
But despite these problems, the rapporteur Roland Ilia introduced them as unintentional “lapsuse”. In this way, he appears to warn Enkeledi Hajros’s on-going confirmation. If the decision, which is expected to be given on Friday, will be in favor of Hajros, this will be a further evidence that KPK applies multiple standards for subjects with similar problems.
Apartment
KPK found that Enkeledi Hajro and her husband signed a fictitious contract for the purchase of an 85 m2 apartment, worth 82 thousand euros, in 2007. For this apartment, she stated that she bought with 70 thousand euro loan, meanwhile which is not expressed at all for the difference of 12 thousand euros.
From the declarations of the Tirana Supreme Court, the real value of the apartment is 70 thousand euros. But she, in cooperation with the retailer, has fictitiously increased the price, marking 82,000 euros. According to her, this maneuver has been made to justify the 70,000 euro loan, as banks do not provide more than 70-80 percent of the value of the property to be purchased.
For this maneuver, the case rapporteur, Roland Ilia, stated that “the subject confirmed as a real value of the apartment the value of 70 thousand euros and as a source of creation the loan” without questioning the transaction.
Credit
Also during the hearing session, KPK did not point out any problems in the “abuse” that Judge Enkeledi Hajro made with a soft loan in 2012.
The Albanian government has for years applied a reimbursement scheme for senior officials who are homeless. Through this program, homeless officials take credit at a second-tier bank and pay only 4% interest. While the rest of the obligation (credit) pays to the state.
To take advantage of this type of loan, the officer should be of middle and high administrative level and be homeless.
Judge Enkeledi Hajro, who in 2012 was a director at the Ministry of Justice, received a mild homeless loan, despite having purchased an apartment since 2007.
According to asset declarations, Hajro used the soft loan to repay the bulk of the commercial loan he had received since 2007. In this way, Enkeledi Hajro has unjustly used soft loan.
But KPK did not mention this scheme at all in the hearing, suggesting that the maneuver of Tirana’s chief justice is no problem for the commissioner’s troupe.
This behavior proves another case of application of various standards, which run the Vetting Commission in their work.
For a similar case of mild credit, the KPK decided dismissal from the office of the judge of E.M ..
In the case of E.M, the KPK considered irregular movements that the judge had carried out with a soft loan. By doing a detailed analysis, however, challenged by Judge E.M, the Vetting Commission decided to dismiss him from office.
Meanwhile, in the case of Enkeledi Hajro, the commissioners’ body did not say anything about the “abuse” of mild credit.
The President of the Court of Tirana came to a hearing on 6 June, before the commissioners Roland Ilia, Valbona Sanxhaktari and Olsi Komici. The decision for Enkeledi Hajron is expected to be announced on Friday, June 7, at 9.00.
