The Independent Qualification Commission (KPK) has dismissed Korça Appeal Judge Brunilda Malo (Orhani).
The KPK has decided to exclude it from the system, as it has identified property problems.
The panel consisted of Xhensila Pine, Roland Ilia and Valbona Sanxhaktari.
During the hearing held on 4 November, the Commission noted as a major problem the lack of documentation of the income received by the deceased spouse of the entity as an administrator and shareholder of D&G Construction Company. The income declared from this activity and from the sale of shares are an important source of household assets and expenses, with a stated value of 24.1 million ALL.
The Commission found that there is no documentary proof of dividend withdrawal nor payment of the tax on profit earned. The Commission’s conclusion was also based on a lawsuit filed by the late Malo against other shareholders for the sale of the quota and the retained earnings of the company.
As a result of excluding these revenues, the entity resulted in a financial impossibility of ALL 19.8 million. Meanwhile, the Commission also identified inaccuracies and other inconsistencies in the asset declarations.
Brunilda Malo began her career in the Albanian justice system in 1995 as a judge in Kolonje. In 2003, she was appointed judge in the Korça Court of Appeal, a task she currently holds.
During the administrative investigation, Malo asked for the panel to be excluded on the grounds that it had not examined the evidence submitted by it as well as a violation of the right to be acquainted with the assessment of the other two criteria. The request was dropped by another judicial body.
