The scandal announced days ago by Boldnews risks seriously hurt the borrowers and Albanian citizens after the government has decided to bring to the Parliament amendments to the Civil Procedure Code which provide for seizure of houses for those who experience financial difficulties in paying loan installments.
According to the changes, the court will issue the execution order based on the deposited documents at the advisory hearing without the applicant’s presence. To this end, the situation seems normal, but in the other change there is an important problem which has to do with the fact that the contractual criminal terms will continue to apply to the borrower even after the issuance of the execution order and enforced execution by bailiff offices .
Such a provision in the law also contravenes the principles of the settlement of contracts because in this way the credit contract will have effects for the borrower even after its resolution, ie after the issuance of the execution order. In this way, the borrower will be involved in a vicious circle that is assumed that in case he will pay installments upon initiation of procedures by the bailiff’s offices, he can only pay penalties and interests due to delays while with the collateral according to the valuation principle with 30% of the value determined by the Housing Entity will not be able to repay more than a small part of the obligation.
The scandal continues when the government removed from its official website the draft decision on amendments to the Civil Procedure Code after the publication of the project by Boldnews. It is not yet known whether MPs will vote for or against, but it is certain that the bank’s oligarchs have caught the government while there is still no response from the opposition. Maybe the banks’ oligarchs have also captured the opposition. Such a scheme will bring thousands of social wounds and the loss of homes for Albanian citizens.
