The Tirana court has flagrantly refused to carry out the re-examination of Agron (Geron) Xhafaj’s voice, contained in the gross material submitted to the authorities by journalist Jetmir Olldashi, in a process proving how prosecutors who investigated the case, Gentian Osmani and Kole Hysenaj and Judge Artan Gjermeni have taken on the role of lawyer for the brother of former Interior Minister Fatmir Xhafaj, publicly charged by his former associate in illegal trafficking, Albert Veliu.Journalist Olldashi’s lawyer, already accused of “false reporting” along with former MP Ervin Salianji over the fact that Albert Veliu’s statements were made public, asked the court to re-examine Agron (Geron) Xhafaj’s voice, raising strong on the actions of the prosecution.
Investigative acts prove that prosecutor Osmani also received material from the Democratic Party that it published, which contained subtitles and musical effects.
On July 22, 2018, more than two months after journalist Olldashi submitted the gross audio material, prosecutor Osmani decides to send material obtained from the Democratic Party for expertise.
The move raises strong suspicions that Prosecutor Osmani, (now permanently dismissed from Vetting and permanently expelled from the justice system), deliberately sent for audio material obtained by the Democratic Party, in which the quality of the voice of the negotiators was impaired, due to musical effects and subtitles.
Because of this poor material, as well as the poor quality with which the Tirana Prosecution had previously taken Agron (Geron) Xhafaj’s voice sample, the British laboratory “JP French Associates” did not have a definitive answer if the voice in audio recording was Fatmir Xhafaj’s brother.
Voice expertise is at the heart of the “Geron Xhafaj” case, and its performance on the gross material is considered by lawyer Indrit Sefa as the key to dismissing the file manipulated by Fatmir Xhafa Police and the prosecution specifically Gentian Osmani and Kole Hysenaj.
For this reason, lawyer Indrit Sefa asked Judge Gjermeni to order the seizure of USB, which is currently a suspended file for Serious Crimes “narcotics trafficking”, and to place the re-examination.
This request was considered unreasonable by prosecutor Kole Hysenaj, as well as by the victim’s lawyer (Geron Xhafaj), Ardian Visha (the latter former Director of External Relations at the General Prosecutor’s Office, accused by the media and former MP Ervin Salianji of defended Agron Xhafa in his sentencing in Italy during the 2000s, destroying documents that required the Italian side to arrest Geron.
Lawyer Visha is also recognized as a permanent defender of malavite segments in the Albanian Courts.
The objections of the “victim” prosecutor and lawyer were unanimously and enthusiastically supported by Judge Artan Gjermeni. (The latter is often accused of being affiliated with the Socialist Party and dangerous criminal groups, such as the Lushnja gang, etc …).
On an interim ruling, he dropped the USB pull request with gross material from the Serious Crime suspended file. In this way, the judge also rendered the request for re-examination ineffective.
In one of the previous hearings, Judge Gjermeni also revoked a decision he had previously made, in which he decided to have Agron (Geron) Xhafaj questioned as a witness at the hearing.
Absurdly, he decided that Agron (Geron) Xhafaj should not speak at the hearing, but only read statements made by him during the preliminary investigation. The decision was challenged by the defendants’ lawyers.
In the face of this objection, Judge Gjermeni directed the parties to answer the questions they had for Agron (Geron) Xhafaj, the victim’s lawyer.
This suggestion also seemed inappropriate for one of the two prosecutors in the case, Genc Qana, who stated at that hearing that this was impossible.
To the lawyers, Agron (Geron) Xhafaj’s reluctance to testify in court seems like a maneuver to avoid hearing his original voice, which could then be easily compared to the voice in the conversation recorded by Albert Veliu.
