In the middle of Tirana less than 100 meters from the District Court, Chief Inspector Dallandyshe Bici collapsed a house on the last floor of a palace, even though the owners own a property certificate. The scandal has been denounced today by the Ajsberg investigative program. The house has been a cripple where the spouse is a German citizen, a well-known architect in Munich, Germany.
Helmut Kok is a German architect from Munich who is married to Albanian Stela Kalavace and has decided to come and invest in Albania as a field professional. Surely he heard Prime Minister Rama call for the absorption of as much foreign investment in Albania as possible.
In full emergency, the ITRC and its inspectors landed in this palace and flattened all the property of German national Helmut Kok.
The story had begun about two months ago when IKMT inspectors went to this house and had a record of overcoming works and imposed a fine of 5 million leke.
Helmut Kok and his companion owned this house with a certificate of ownership through this sale-purchase contract. In September, they addressed the Municipality of Tirana to obtain permission for the internal reconstruction of their apartment. As they themselves declare, but that also shows this document they are equipped with the respective permission and have continued the work according to the laws in force.
In these conditions IKMT in violation of the law went and inspected the works in this building. According to the organic law operating IKMT this remuneration Within the yellow line there is only the local inspectorate of the Municipality of Tirana. After several court hearings and a court-ordered expertise, the trial panel announced the announcement of the decision on December 4, 2017.
But just 5 days ago on a weekend where Albania flooded everywhere, the ITRC along with the state police went in and forced themselves into a private home violating any law, legal norm, and the country’s constitution.
So the state police had also deposited the restoration permit as well as the verbal statement via Mrs. Stela Kalavace’s phone that no one was in the house and could smuggle into a private property.
They made a criminal complaint to IKMT and the state police who came in forcibly to their apartment. But the case lawyer Endri Bimi closed the case by finding no elements of the criminal offense. Under these conditions they turned to the Court which left a series of duties to the prosecutor to investigate. The court found insufficient reasoning for prosecutor Endri Bimi that this is an administrative and non-criminal matter. It is unclear why it is not called a criminal case when an official arbitrarily decides to demolish the apartment of citizens even though they possess a property certificate for this dwelling. Also, how can the State Police action to tear the door and enter forcibly into a private home not in terms of flagrancy and without a court decision in hand. This issue remains the court to further measure the legality of the acts of state institutions. We can say that in a bandit and antitrust manner, the ICMT and the state police ripped off the door and went inside to cut off everything, they did not keep any records to submit it at the moment, and did not even allow the family lawyer to be present in this illegal action.
The Kok and Kalavace couples had come to Albania as well as possessors of this property even to invest their business. Now they seem contrite and very wondering about their actions. It seems that they have entrusted the call of Prime Minister Rama to invest in Albania.
