Dritan Zagani, former State Police officer denouncing high criminal liaison officials, claims that Karlo Bolino, the owner of Shqiptarja.com and Report TV, has falsified some Italian documents. Although he was taken as a defendant and sent for trial by the Prosecution for Serious Crimes for “Abuse of Office” and “Not Criminal”, he sent a criminal report through the postal service at the General Prosecutor’s Office of the Republic of Albania. The latter with letter no. 1518/2 prot, dated 24.11.2015 has sent the criminal report for the Prosecutor’s Office of Tirana. From the content of the forwarding material it turns out that Dritan Zagani has filed allegations of some data published in him in the newspaper “Shqiptarja.com” on 13.11.2015. According to this article refers to the fact that citizen Dritan Zagani was paid from 2000-3000 euros for any information he provided, by Italian employee A.G, as well as other data, which he claims to be untrue. He claims that the facts are transformed and added in malice, and are made public for the purpose of denigrating his person. And this fact he attributes to citizen Karlo Bolino, newspaper owner and citizen Ana Pogi, as director of the Italian Interforce Office, claiming that the information contained in the criminal offense of “Falsifying Documents” is included in the data.
In connection with this criminal report was examined by the Prosecutor’s Office, the official website of “Shqiptarja.com”, where the article “Zagani Case” is the true story of Ana Pogi. In this paper, among other things, refers to the fact that Ana Pogi as an Italian official of the Interpol Office has sent a letter to the Prosecutor’s Office of Serious Crimes, according to the latter’s request, for information requested for a phone number with which he has communicated the citizen Dritan Zagani and reflected the content of the letter sent by this office, publishing both the relevant papers. There is also a description of the position of the denouncer for the investigations conducted against him.
In order to obtain information on whether these two documents result to have been part of the criminal proceeding and for the state and extent of this criminal proceeding, the Tiranë Prosecutor’s Office Prosecution Office, in the framework of actions of a verifier character, was requested information from the Prosecutor’s Office for Serious Crimes. The latter with letter no. 2476 prot, dated 29.12.2015 has sent the request for trial related to the criminal proceeding no. 286/1 of 2014, dated 23.12.2015, which dates back approximately one year ago from the date published on 13.11.2015. According to the request for trial it turns out that citizen Dritan Zagani was taken defendant and sent for trial for the criminal offense of “Abuse of Duty” and “Criminal Notification”. The two documents result to be part of the criminal proceeding no. 286/1 of 2014, where they were recognized as defendants and lawyers according to their legislation.
The Prosecution concluded that the claims of the claimant (complainant), Dritan Zagani regarding the authenticity of the content of the documents sent by the Intermediary Office, upon the request made by the Prosecution, constitute in themselves the object of proving the criminal offense for which he is charged he and the allegations in connection with these facts have been the object of the prosecutor’s assessment and are subject to court’s assessment during the trial of the case, being thus closely and inevitably linked to it and as such they can not stand alone. According to the Prosecution, these claims can not be evaluated by another body other than the court, as this would lead to unfair interference in court proceedings.
The indictment says Zagan’s suicide claim must be prosecuted. “In the analysis of the allegations and objections regarding the subject of this claim lodged by the complainant, the Court establishes that there is no evidence of the reasons justifying the registration of the criminal proceeding and therefore the continuation of the preliminary investigations concerning the criminal charges of made by the Complainant Dritan Zagani. Referring to the indispensable requirements contained in the special provision of the criminal law law, Article 120 of the Criminal Code, the Court finds the right of the prosecutor’s office to fail to initiate criminal proceedings, “reads the decision court.
