An employee of the National Agency of Natural Resources is the first “bail” of the “Beketi” file.
The Tirana Court has sentenced him to 18 months. Bold News has secured the court’s decision, where it turns out that SokolKoci has “closed” his eyes before abuses at the Kalivaç hydropower plant.
The decision states that the court was set in motion by the prosecution, which sent to trial Francesco Beketin, Mauro De Renzis, Liliana Condomitti, ErjonaTroplini, StavriPeci, FetahDervishi, SokolKoci and several companies. Koci demanded a shortened trial, benefiting also the reduction of the sentence.
According to the court, from the act of control conducted by the Directorate of Big Taxpayers to the company “Energji” sh.pk of 2014, has resulted that the value of the works sold to the company “KGE” by the company “Energji” was
several times higher (up to 23 times) that the value of the works that this company (“Energji”) purchased from its subcontractors, since the works on the construction of H / C Kalivaç, “Energji” sh.pk company made with third subcontracting companies . From the expert acts carried out during the preliminary investigation, it was concluded that the company “Energji” sh.pk results to have increased the prices of the works on sale many times from the purchase prices and has sold the volume of works in quantities greater than volumes of purchased works. Also, it turns out that the company “Energji” has sold for the company “Kalivaç Green Energy” also works which it has not done at all, facts that occurred during 2007 -2013.
The prosecution’s representative claimed that, over the years, the company “Energji” has released some situations with false data and fictitious invoices with the description “Works in HecKalivaç”, based on these situations with false data. The National Natural Resources Agency, as the supervisory institution for the implementation of the concession contract, has carried out several inspections at the Kalivaç Hydropower Plant site to see the performance of the development work. In the monitoring act held by this working group it is noted that there was a significant lack of documentation on the site and the working group could not provide a number of important documents that are needed to carry out the audit as a works journal, the mapping act , the work supervisor’s report, the approved project and other required materials.
Asked during the preliminary investigations, regarding this monitoring act, AKBN employees who have performed the audit stated that this monitoring act was held in the conditions of a complete lack of documentation (project, situation, preventive, supervisor relationship, worksheets, etc.). The monitoring lasted only two or three hours, no measurements were made on the site and referrals in the monitoring act were made only on the basis of the statements of the company’s representative.
The same situation continued in 2011, where in the act of monitoring conducted was noted the total lack of documentation especially of the situation and reports of the supervisor of the works, which confirms the accuracy of the work presented in situations but on the Kalivaç “There were no works supervisors, at least until 2011. Even in 2012, a monitoring act was carried out, specifically on 13.03.2012. Following the on-site monitoring, AKBN has asked the Concessionaire company to provide the necessary and necessary documentation for conducting the monitoring.
For the monitoring carried out, the monitoring team has prepared a summary report, and there is a technical report regarding the topographic part signed by the two topographers of this group, FetahDerishi and SokolKoçi. The summary report reflects the work done referring to situations presented by the concession society. From the content of the report it turns out that the completed works have been measured and verified by the engineering and specialist topographers who have prepared the technical relation. From the content of the technical report it results that the group of topographers carried out field measurements and made comparisons between reported works on actual situations and measurements.
Regarding the data measured in this technical report, AKBN was requested to provide the prosecution with any data confirming the measurements carried out as maps, CDs, etc. In response to the information requested, AKBN sent information to the defendant FetahDervishi, which reflects the fact that topographers performed the measurements only on the right side and not on the left side (because on the left side it was impossible to move due to lack of bridge). The same facts have also been stated by defendants SokolKoci and FetahDervishi. The reports reported to the left by the company “Kalivaç Green Enegji” are at a much larger volume than works on the right.
The allegation shows that it is proven that the group of topographers did not carry out any measurements and did not verify what work was actually done, reflecting in the technical report that the measurements were carried out untrue when the measurements had not taken place. The defendant SokolKoçi, in the performance of his duty, as a specialist topographer, at the National Agency for Natural Resources, did not carry out measurements to verify the works actually carried out in the Kaliavac hydropower plant, in cooperation with other persons, prepared a relation technician, in which they have reflected false data. Based on this technical report, the final report of March 2012 was prepared, reflecting the measurements carried out by the group of topographers, on the works carried out on the Kalivaç hydroelectric power plant, measurements which were not actually performed at all.
